Do You Need a Lawyer to Get Divorced?

You can file for divorce without a lawyer — but most clients prefer our assistance for:

  • ensuring the application is accurate and complete

  • managing separation under one roof

  • serving the application correctly

  • avoiding delays or adjournments

  • aligning the divorce timing with property settlement or parenting matters

  • preparing for the 12-month limitation period following divorce

Our role is to make the process smooth, timely and stress-free.

The Divorce Process – Step by Step

We guide Hills District clients through each stage:

1. Eligibility Check

You must be separated for 12 months and 1 day, even if still living in the same home.

2. Preparing the Application

We prepare and file either:

  • a sole application, or

  • a joint application if both parties agree.

3. Serving Documents (for sole applications)

We arrange proper service and complete all required affidavits.

4. Divorce Hearing

Most matters do not require you to attend unless children under 18 are involved.

5. Divorce Becomes Final

The divorce is final one month and one day after the Court makes the Order.

Throughout the process, you will be fully supported and updated.

Divorce, Property & Parenting — What Comes First?

Many Hills District clients ask: Should I sort property or parenting before the divorce?

Here is the simplest way to understand it:

  • Divorce ends the marriage.

  • Property settlement and parenting arrangements are separate processes.

  • You do not need to wait for your divorce to finalise property or parenting issues.

  • You must resolve property settlement within 12 months after your divorce becomes final, or you may need special permission from the Court.

We help you map out the correct order based on your circumstances, timing, safety considerations and financial needs.
