Child Support in NSW: What Are Your Options?

When parents separate, one of the first practical questions is: “How will child support work?” Every family’s circumstances are different, but there are clear options under the law.

The Basics of Child Support

Child support is financial support paid by one parent to the other to help cover the costs of raising children. It’s usually assessed by Services Australia (Child Support Agency) based on:

  • Each parent’s income,

  • The number of nights the child spends with each parent, and

  • The age and needs of the child.

Option 1: Administrative Assessment

The Child Support Agency can make an administrative assessment and collect payments directly. This is the most common starting point. Parents can also arrange private collection between themselves once the assessment is made.

Option 2: Change of Assessment

If the standard formula doesn’t reflect your situation, you can apply for a Change of Assessment. Examples include:

  • High medical or schooling costs,

  • A parent earning income through a company or trust,

  • Circumstances not captured in the basic formula.

Option 3: Child Support Agreement

Parents can also make their own Child Support Agreement:

  • Limited Agreements: Can be made once there’s an administrative assessment in place. They last up to 3 years and can be ended more easily.

  • Binding Child Support Agreements: Require both parents to obtain independent legal advice before signing. They are enforceable and can set out tailored arrangements, such as payments for school fees, health insurance, or extracurricular activities.

Verbal agreements often lead to disputes. A written agreement — especially a Binding Child Support Agreement — gives clarity, protects both parents, and ensures children’s needs are met without ongoing conflict.
